If the singers don't do it themselves (which is pretty rare), the band, music director, and a few other folks, work something out and then offer it to the singer for their approval.

IIUC, the singers typically put in for a block of 4-5 songs per theme week (things are a little different in the semi-finals), and then AI goes about getting the rights to have the songs rebroadcast. (So yes, Fuel or their management would have known about Chris' intentions, and likely more than 2 weeks ago.) After the rights are granted, the singers are given a packet that tells them what cleared or did not clear. It is unclear how far in advance they get the song information though.
